My client from Warsaw was prepared to a tee — or so she thought. Passport in her folder, NIE number sorted in advance, bank transfer ready to go. Then the notary in Alicante calmly set her documents aside and asked her to come back the following week with one missing bank statement. No drama. No argument. Just the rules — and quite rightly so.

KYC and AML — what do these terms actually mean?

KYC stands for "Know Your Customer." Every institution involved in a property transaction — the estate agency, developer, bank, notary — has a legal obligation to verify who you are and where your money comes from. This isn't a matter of goodwill or how much everyone likes each other. It's a requirement that applies across the whole of Spain, no exceptions.

AML — Anti-Money Laundering — is the broader set of rules designed to prevent dirty money from entering the legitimate economy through property purchases. Agents, banks and notaries assess whether a transaction looks credible, and in doing so they help combat the financing of terrorism. The pleasant side effect? A market you can actually trust.

Why does Spain enforce these rules so strictly?

The Spanish property market has attracted buyers from around the world for years — retirees, investors, families looking for a second home in the sun. That popularity comes at a price: without robust checks, the market would become an easy target for those wanting to hide illegal money behind the pretty facade of a sea-view apartment.

My clients are often surprised when I tell them that simply having the money and a passport isn't enough. Yet if something is missing from the paperwork — the bank can block the transfer, the notary can hold up the title deed, and the whole transaction can slip by weeks or even months. It's far better to hear about this over a coffee with your adviser than to discover it at the notary's desk.

What documents do you need to prepare?

First layer — identity and basic formalities

The foundation is a valid passport or national ID card, plus your NIE number. Without it, you cannot sign a contract in Spain, open a bank account, or complete any property transaction. On top of that, you'll need proof of address — a utility bill or an equivalent official document.

Second layer — finances, the real AML part

This is where things genuinely catch buyers off guard. Bank statements from recent months, proof of income, tax returns. If the funds for the purchase come from selling a property, shares or another asset — documents confirming that specific transaction will be required too. Banks, agents and notaries check all of this very thoroughly.

Buying off-plan? Verification doesn't end when you sign the reservation

Buying a new-build property at the construction stage has its own set of rules. You pay in instalments — a deposit, then further payments as the build progresses. And here's something many people simply don't know: each instalment triggers a new AML check. The source of funds is verified at every stage — from the reservation right through to the final deed signing.

The process can take months, sometimes years. It's not a case of showing your documents once and being done with it. But that's precisely why you can be confident that everything is transparent at every step. Nobody will blindside you with questions just as you're collecting the keys.

The notary's role — ally, not gatekeeper

A Spanish notary isn't a rubber-stamp official who mechanically witnesses signatures. Before signing the title deed, they verify the identity of both parties, the payment method and the source of funds. If anything raises doubts — they have both the right and the duty to halt the transaction.

Back to my client in Alicante. She returned a week later with the missing statement. She signed the deed without a hitch. The notary wasn't being difficult or overzealous — he was doing his job, which at the same time was protecting her. If something had been wrong with the paperwork, she'd have found out at his desk, not after wiring a sum equivalent to the price of a home.

These rules work in your favour — genuinely

Classic illegal schemes involve buying with cash from an unknown source, concealing the real owner behind a nominee, or quickly reselling a property to "clean" the money. These aren't plotlines from a thriller. They're real cases that regulators deal with every day.

Without these safeguards, prices could be artificially inflated, and you could unknowingly buy a property carrying serious legal baggage. AML checks protect you — the honest buyer — just as much as they protect the financial institutions themselves. It's worth keeping that in mind the next time yet another document feels like pointless red tape.

The good news: digitalisation is speeding everything up

Spain is embracing modern tools with growing confidence. Digital identity verification, automated transaction monitoring, data sharing between EU member states — all of this accelerates procedures and makes life easier for those whose paperwork is in order.

For honest buyers, that means fewer papers on the table and less waiting around. Checks are becoming more effective, and the stress — considerably less. More security, less bureaucracy for those with nothing to hide. That's a direction I'm very happy with.
